    Referenties Minimumeisen: De inschrijver toont zijn technische en beroepsbekwaamheid aan door het voorleggen van minimaal twee en maximaal vijf relevante referenties met betrekking tot de ontwikkeling, implementatie en/of het beheer van een geschenkbonsysteem voor steden of gemeenten.

    De opgegeven referenties moeten voldoen aan de volgende minimale voorwaarden:

    de referentie heeft betrekking op een geschenkbonsysteem dat werd uitgewerkt voor een stad of gemeente met een omvang die vergelijkbaar is met die van Stad Lier;

    minstens honderd handelaars zijn of waren aangesloten bij het geschenkbonsysteem;

    de dienstverlening waarop de referentie betrekking heeft, werd uitgevoerd gedurende de laatste drie jaar, te rekenen vanaf de uiterste datum voor de indiening van de offertes, of is op die datum nog in uitvoering.

    De inschrijver bezorgt per referentie een bondige beschrijving van maximaal 500 woorden. Deze beschrijving bevat minstens de volgende gegevens:

    de naam van de stad of gemeente;

    een omschrijving van de aard en de omvang van de opdracht;

    een beschrijving van het opgezette geschenkbonsysteem en de voornaamste functionaliteiten ervan;

    de periode van uitvoering en, in voorkomend geval, de duur van de samenwerking;

    het aantal aangesloten handelaars;

    de rol en de concrete verantwoordelijkheden van de inschrijver binnen de opdracht;

    de actuele stand van de opdracht: beëindigd of nog in uitvoering;

    de naam, functie, het telefoonnummer en het e-mailadres van een contactpersoon bij de betrokken stad of gemeente.

    Enkel referenties die voldoende duidelijk en controleerbaar zijn beschreven en die aantonen dat aan alle voormelde minimumvoorwaarden is voldaan, worden in aanmerking genomen.

    De aanbestedende overheid behoudt zich het recht voor om de opgegeven referenties te verifiëren bij de vermelde contactpersonen. Door het indienen van de referenties verleent de inschrijver toestemming om deze contactpersonen te benaderen.

    Wanneer minder dan twee geldige referenties worden voorgelegd of wanneer uit de voorgelegde informatie niet blijkt dat aan de minimumvoorwaarden is voldaan, wordt de inschrijver niet geselecteerd.

    Wanneer meer dan vijf referenties worden ingediend, houdt de aanbestedende overheid uitsluitend rekening met de eerste vijf referenties in de volgorde waarin zij in de offerte zijn opgenomen.

    Deskundig project- en supportteam Minimumeisen: De inschrijver toont zijn technische en beroepsbekwaamheid aan door aan te tonen dat hij voor de uitvoering van de opdracht kan beschikken over een voldoende deskundig en multidisciplinair project- en supportteam. Het voorgestelde team moet gezamenlijk beschikken over de deskundigheid die noodzakelijk is voor de implementatie, ingebruikname, ondersteuning en verdere werking van het geschenkbonsysteem. Het team moet minstens expertise omvatten op de volgende domeinen:
    • projectleiding en coördinatie van de implementatie;
    • technische implementatie, configuratie en gegevensmigratie;
    • informatieveiligheid en gegevensbescherming;
    • operationele ondersteuning en helpdesk;
    • financiële verwerking, settlements en reconciliatie van transacties. Eén persoon mag meerdere van deze rollen of expertisedomeinen opnemen, voor zover uit de voorgelegde informatie duidelijk blijkt dat hij of zij over de vereiste deskundigheid beschikt. De inschrijver moet minstens kunnen beschikken over:
    • één projectverantwoordelijke die aantoonbare ervaring heeft met de implementatie of het beheer van digitale systemen met een vergelijkbare functionele en organisatorische complexiteit;
    • één technisch profiel met aantoonbare ervaring inzake de technische implementatie, configuratie, integratie en/of migratie van digitale platformen;
    • één profiel met relevante expertise inzake informatieveiligheid en gegevensbescherming;
    • voldoende operationele en functionele expertise om tijdens de looptijd van de opdracht ondersteuning te bieden aan Stad Lier, de fysieke verkooppunten, de aangesloten handelaars en de gebruikers van het geschenkbonsysteem;
    • voldoende expertise inzake de financiële verwerking en opvolging van transacties, waaronder settlements, uitbetalingen en reconciliatie. De inschrijver bezorgt een overzicht van het team dat voor de uitvoering van de opdracht kan worden ingezet. Per voorgesteld teamlid vermeldt de inschrijver minstens:
    • de naam en functie;
    • de rol en verantwoordelijkheden binnen deze opdracht;
    • de relevante opleiding en/of beroepskwalificaties;
    • de relevante beroepservaring;
    • de specifieke ervaring die verband houdt met de rol die binnen deze opdracht wordt opgenomen;
    • de relevante projecten of opdrachten waaruit deze ervaring blijkt;
    • de wijze waarop de continuïteit wordt verzekerd bij tijdelijke of definitieve afwezigheid. De inschrijver voegt per teamlid een beknopt curriculum vitae of gelijkwaardig document toe waaruit de opgegeven ervaring en deskundigheid voldoende duidelijk en controleerbaar blijken. De inschrijver bezorgt daarnaast een eenvoudig organigram of teamschema waarin de onderlinge rolverdeling, verantwoordelijkheden en back-upregeling worden weergegeven. Enkel profielen waarvan de deskundigheid voldoende duidelijk en controleerbaar wordt aangetoond, worden in aanmerking genomen voor de beoordeling van deze minimumvereiste. Wanneer uit de voorgelegde informatie niet blijkt dat het voorgestelde team gezamenlijk beschikt over alle hierboven vereiste expertisedomeinen, voldoet de inschrijver niet aan dit selectiecriterium en wordt hij niet geselecteerd.     26. The staffing proposed in the tender shall serve as the basis for execution of the assignment. If during execution a proposed team member is replaced, the substitute must possess at least equivalent relevant expertise and experience. The contractor shall communicate such replacement in advance to City of Lier and provide, upon request, the necessary evidence demonstrating equivalence.

    * Het UEA, waarmee de ondernemer verklaart dat hij zich niet bevindt in een van de uitsluitingssituaties als bedoeld in de artikelen 67 tot 69 van de wet van 17 juni 2016. Artikel 70 van de wet van 17 juni 2016 betreffende de overheidsopdrachten is van toepassing. Voor de in artikel 67 van de wet bedoelde uitsluitingsgronden deelt de gegadigde of inschrijver op eigen initiatief mee of hij bij het begin van de procedure de in artikel 70, lid 1, bedoelde corrigerende maatregelen heeft genomen.

    * Deze bepaling is individueel van toepassing op alle deelnemers die samen als een combinatie een offerte indienen en op alle derde entiteiten op wiens draagkracht de inschrijver desgevallend beroep doet. De inschrijver mag zich niet bevinden in één van de in de artikelen 67 tot en met 69 van de Wet van 17 juni 2016 bedoelde situaties. Dit behelst de verplichte uitsluitingsgronden, de uitsluitingsgronden in verband met fiscale en sociale schulden, en de facultatieve uitsluitingsgronden. Indien een bovenvermelde uitsluitingsgrond van toepassing is op de inschrijver, dient de inschrijver spontaan te bewijzen dat de corrigerende maatregelen die hij heeft genomen voldoende zijn om zijn betrouwbaarheid aan te tonen ondanks de toepasselijke uitsluitingsgrond.     • het attest van aangifte en van betaling van de sociale zekerheidsbijdragen van de RSZ;
    • het attest van BTW-plichtigheid en het attest fiscale schulden (FOD Financiën);
    • de juridische situatie van de ondernemingen (niet-faillissement of soortgelijke situatie) bij de Kruispuntbank van Ondernemingen (of KBO);

    * De inschrijver voegt een recent uittreksel uit het strafregister toe dat betrekking heeft op de inschrijvende rechtspersoon. Het uittreksel mag op de uiterste datum voor ontvangst van de offertes niet ouder zijn dan zes maanden. De aanbesteder behoudt zich het recht voor om, indien dit voor de controle van de uitsluitingsgronden noodzakelijk is, bijkomende bewijsstukken op te vragen

This specifically concerns the RSZ certificate, the certificate of tax debts and the 'legal situation' certificate.

    6. The bidder must nevertheless attach the following documents to their tender:

    7. • Belgian bidder employing staff subject to the social security legislation of another EU Member State: a recent certificate issued by the competent foreign authority confirming that they have fulfilled their obligations regarding payment of social security contributions in accordance with the legal provisions of the country where they are established.

    8. Foreign undertakings are requested to attach to their tender all documents that the Contracting Authority can consult for Belgian undertakings via the Telemarc application, namely:

    9. • the certificate of declaration and payment of social security contributions of the RSZ;

    10. • the VAT liability certificate and the tax debts certificate (FOD Finance);
